Lottery Commission records, 1988-2008, bulk 1991-2008.

The Texas Lottery Commission administers the Texas Lottery (generating revenue for the State of Texas), and also the Texas Bingo Enabling Act (providing authorized organizations the opportunity to raise funds for their charitable purposes by conducting bingo); in both areas the commission is responsible for maintaining security and integrity. Records of the Texas Lottery Commission, 1988-2008, bulk 1991-2008, document the commission's operations in developing, marketing, conducting, and administering the Texas Lottery; regulating charitable bingo games in the state; policymaking; and seeking legal redress against its licensors for violations of state law and lottery policies. Types of records include meeting agenda, minutes, transcripts, and supporting documentation; correspondence and interoffice memoranda, with some attachments; agency orders; policy and procedure manuals; legal documents; meeting notes; two videocassettes; reports; working papers; a prize structure analysis; a dvd; a press release; lottery tickets; and design proofs. Meeting files of the Lottery Commission include agenda, minutes, transcripts, and supporting documentation (interagency agreements, an inventory, rules, presentations, proposals for decision before the State Office of Administrative Hearings, orders of the Lottery Commission, narrative and statistical reports, correspondence, interoffice memoranda, legal opinions, etc.). The overall date span is 1993-2008. The records comprise the following files for meetings of the Texas Lottery Commission: copies of agenda (open meetings notices) dating November 1993-December 2007; copies of minutes dating November 1993-July 1997; copies of transcripts of meetings dating June 1995-June 2008; and supporting documentation (commission meeting notebooks) dating October 1997-December 2005. Also included are copies of agenda (open meetings notices) for the Bingo Advisory Committee, dating April 1995-November 2007. Administrative correspondence of the agency, dating 1988-2001, bulk 1991-2001, is in regard to lottery and bingo operations concerning interpretation of the Texas Lottery Act and the Bingo Enabling Act, Texas Lottery rules, winnings, possible gambling violations and fraud, interstate lottery questions, lottery retailers, marketing opportunities with the Texas Lottery, advertisers, requests to use the Texas Lottery logo, unsolicited game ideas, unethical marketing by third parties, and personnel matters. Employee classification plans, the agency's strategic plan, and legislative appropriation requests are also filed within this series. Agency orders, 1993-2008, bulk 1994-2008, were issued by the commission at large and by internal divisions, concerning legal cases between the commission and its licensors that were heard by an administrative law judge who made and filed a proposal for decision containing the judge's findings of fact and conclusions of law. Many of the orders concern revoking lottery sales agent licenses for lack of compliance with lottery policies, such as not delivering funds received from the sale of lottery tickets to the commission in a timely manner, and transferring ownership of a business selling lottery tickets to an unlicensed person or entity; denial of application to renew a license to conduct bingo; revoking bingo operator licenses for failure to remit prize fees to the commission and for failure to disburse the required percentage of receipts for charitable purposes; and denial of motions for hearing. The orders sometimes include attachments and exhibit materials. Policy and procedure manuals, 1992-2002, define the operations of the lottery, including information technology systems, game structure and security, marketing, prize drawing, collections and enforcement, facilities support, and financial administration. All of these policies and procedures manuals have since been superseded. Manuals through 1993 were created by the Texas Comptroller of Public Accounts, which had authority over the Texas Lottery until September of that year. Legal opinions and advice, dating 1994-2001, bulk 1998-2000, document issues submitted by the commission to its legal counsel for legal assessment and action. Typical issues represented include infractions of lottery rules by licensed retailers, license revocation, license application denial, bingo operations conducted without a license, clarification of the commission's legal authority, approval of lottery ticket text, rule making, and open records questions. Game files of the commission, 1992-1995, bulk 1992-1993, comprise documentation on the development of Lone Star Millions, the commission's first instant ticket game, and examples of lottery tickets, including a commemorative Cash 5 first-run ticket.
